This Agreement governs the terms by which clients of Michael Messer Photography obtain the right to use the digital photo through the web site located at www.michaelmesserphotography.com.

1. Acknowledgement

By downloading content from this site, you acknowledge that you have read this agreement and understand it. Through Michael Messer Photography agreeing to provide the digital photo, you agree to be bound by the terms and conditions of this agreement.

2. Downloading Terms

Michael Messer photography hereby grant to you continual, non-exclusive, non-transferable, worldwide permission to use the digital photo for the permitted uses only. Unless the activity or use is a permitted use, you cannot do it. All rights in and to the digital photo, including, without limitation, all copyright and other intellectual property rights relating to the digital photo, are retained by Michael Messer Photography.

3. Permitted Uses

You may only use the digital photo for Story Bridge Adventure Climb. You cannot alter or modify the digital photo in anyway, and or sell it to others for consumption, reproduction or re-sale. Any use of the digital photo that is not a permitted use shall constitute infringement of copyright.

Additional permitted uses must be approved in writing by Michael Messer Photography.

4. Refund Policy

Due to the nature of digital products being immediately accessible upon purchasing, no refunds of any fees or other amounts paid by you in connection with the digital photo will be allowed under any circumstances. If the digital photo is corrupted and cannot be opened, please contract Michael Messer Photography.

5. Terms of Agreement

This Agreement is effective until it is terminated. The Agreement terminates without notice from Michael Messer Photography if at any time you fail to comply with any of it's terms.

You can terminate this Agreement by destroying the Content, along with any copies or archives of it or accompanying materials (if applicable) and ceasing to use the digital photo for any purpose.
